Terms of service

These terms govern your use of thecobaltsystems.com. If you become a client, a separate signed services agreement governs that work, and where the two conflict, the signed agreement wins.

Using this website

You may use this site for lawful purposes only. Don't attempt to breach its security, scrape it at volume, interfere with its operation, or use it to send anyone unlawful or harmful content.

Nothing here is a contract or a guarantee

The prices, packages, timelines, and example results on this site are illustrative and may change. Nothing on this website constitutes a binding offer. Any figures shown are from specific engagements under specific conditions and are not a prediction of what your business will achieve.

Our services, in outline

We provide website design and hosting, CRM and automation setup, paid advertising management, search optimisation, review generation, and related marketing services. What's included in your engagement is defined in your signed agreement, not here.

Who owns what

This is the part most agencies are vague about, so we'll be specific.

Yours, registered in your name from day one: your domain, your Google Business Profile, your Google Ads account, your Meta Business Manager and pixel, your business telephone number, your customer and lead data, and your reviews. We take manager or partner access to these. We do not take ownership of them.

Ours: the website build, its design and code, the hosting environment, the CRM configuration, and the automation workflows, all of which run on our platform. These remain our property and are licensed to you for the duration of your engagement.

If the engagement ends: we will export your site content, your lead and customer data, and your assets, hand them over, and continue hosting for 30 days so you can migrate. We won't withhold your domain, your advertising accounts, your telephone number, or your customer list under any circumstances.

You keep ownership of anything you give us — logos, photographs, copy, trade marks — and you grant us permission to use it to deliver the work. You confirm you have the right to give us that material.

Payment

Setup fees are due before work begins. Monthly fees are billed in advance. Late payment may result in services being paused after written notice.

Third-party and usage costs are separate

Our fees cover our work — building, managing and optimising your marketing. They do not include the costs charged by the platforms we run that work on. These are billed to you, either directly by the provider or passed through to you at cost, and include:

  • Advertising budget — whatever you choose to spend on Google Ads, Meta Ads or Local Service Ads is paid directly to those platforms, not to us. We never take a percentage of it.
  • Text messages (SMS) — sent through your CRM and telephony provider, priced per message. High-volume messaging — reminders, follow-ups, review requests, campaigns — carries a per-message cost.
  • Emails — bulk and automated email sending is priced by volume through the email provider.
  • Telephone numbers and calls — any business or tracking numbers we provision, and the per-minute cost of calls and any AI voice minutes, are usage-based.

These costs scale with how much marketing you do, so they vary month to month. We'll always be transparent about them, and we'll tell you before anything you do would materially increase them. For most clients they're modest — typically a small monthly amount on top of the plan fee — but they are your responsibility, not ours.

Term and cancellation

Growth and Dominate carry a 90-day initial term, because paid advertising cannot be honestly evaluated in less time. After that, either party may end the engagement on 30 days' written notice. The website lease carries a 12-month term. Systems is month to month.

The 90-day guarantee

If, within 90 days, we have not produced booked appointments at a cost that makes sense for your business, we will continue working at no charge until we do, or you may end the engagement without owing anything further. This applies only where you have maintained the agreed minimum advertising budget, responded to the leads we generated, and completed onboarding within seven days. We will show you the data either way.

What we don't promise

We cannot guarantee specific rankings, lead volumes, revenue, or return on investment. We depend on platforms — Google, Meta, GoHighLevel, Twilio — whose policies, pricing, and algorithms are outside our control. We are not responsible for your results where you don't answer leads, change your pricing or service area without telling us, or lose capacity to take on work.

Limitation of liability

To the fullest extent the law allows, our total liability arising from your engagement is limited to the fees you paid us in the three months preceding the claim. We are not liable for indirect, incidental, or consequential losses, including lost profits or lost business opportunity. Nothing here limits liability that cannot lawfully be limited.

Governing law

These terms are governed by the laws of the State of Colorado, and any dispute will be brought in the state or federal courts located in Denver County, Colorado.
